1. Overview
These Terms & Conditions apply to all coaching programs, lessons, events, bookings, products and services provided by Excel Tennis Pty Ltd (“Excel Tennis”, “we”, “our” and “us”).
By accepting these Terms & Conditions, creating an account, submitting a registration or completing a booking, the customer agrees to:
- These Terms & Conditions;
- The Excel Tennis Policies;
- Any program-specific information or booking conditions provided before enrolment; and
- Any applicable conditions displayed through the Excel Tennis Customer Portal.
The customer also acknowledges the Excel Tennis Privacy Policy.
Where a customer registers a child or another participant, they confirm they are authorised to accept these Terms & Conditions and Policies on that participant’s behalf.
Nothing in these Terms & Conditions excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
2. Customer and Participant Information
Customers must provide accurate and current information when registering or making a booking.
This includes relevant contact, participant, medical, safety, emergency-contact, billing and payment information.
Customers must notify Excel Tennis if relevant information changes.
Excel Tennis may rely on the information provided when managing enrolments, payments, communications and participant safety.
3. Enrolments and Bookings
Enrolments and bookings are subject to:
- Availability;
- Completion of required payment arrangements;
- Player suitability;
- Program requirements; and
- Compliance with these Terms & Conditions and the Excel Tennis Policies.
A registration, enquiry or waitlist submission does not guarantee a place unless the booking is confirmed by Excel Tennis.
For Term-Based Programs, a player’s place is not confirmed until the required enrolment and direct debit payment arrangements have been completed through the Excel Tennis Customer Portal, unless Excel Tennis confirms otherwise in writing.
Casual Program bookings are confirmed only once the required booking and payment process has been completed through the Excel Tennis Customer Portal or App, and do not automatically reserve the same weekly time for future sessions unless Excel Tennis confirms otherwise.
Excel Tennis may recommend or transfer a participant to a more suitable class or program based on age, experience, ability, safety or program availability.
4. Term-Based Enrolments and Authorised Future Term Payments
Term coaching programs are offered as full-term enrolments.
Where a participant joins after a term has commenced, fees will generally be adjusted to reflect the remaining scheduled sessions.
Term-Based Program fees are paid by direct debit through the Excel Tennis Customer Portal using an authorised bank account, credit card or debit card payment method. Term-Based Program enrolments require valid authorised direct debit details unless Excel Tennis agrees otherwise in writing.
By accepting an ongoing payment arrangement, the account holder authorises Excel Tennis and its payment provider to process future term fees using the authorised payment method.
Before processing future term fees, Excel Tennis will provide advance written notice confirming:
- The relevant enrolment;
- The amount to be processed;
- The scheduled payment date; and
- The deadline for requesting a change or discontinuing the enrolment.
Customers wishing to change or discontinue a future term enrolment must notify Excel Tennis in writing before the deadline stated in the payment notice.
Unless notice is received before that deadline, the future term payment may be processed under the ongoing payment authority.
Removing or cancelling a payment method does not by itself cancel an enrolment or remove fees already due.

5. Fees and Payments
Customers agree to pay the fees displayed or communicated at the time of booking or enrolment.
Transaction and payment-processing fees may apply and will be displayed or communicated through the website, Customer Portal or booking process.
If a payment is declined, reversed or otherwise unsuccessful, Excel Tennis may:
- Request an alternative payment method;
- Suspend participation;
- Release a reserved place; or
- Cancel the enrolment if payment is not resolved within the required timeframe.
Customers are responsible for any charges imposed by their own bank or payment provider.
6. Cancellations, Credits and Refunds
Customer cancellations, withdrawals, credits and refunds are managed under the Excel Tennis Credit & Refund Policy.
Missed lessons and make-up arrangements are managed under the Excel Tennis Missed Class & Make-Up Policy.
Weather-affected lessons are managed under the Excel Tennis Weather Policy.
Where Excel Tennis cancels a service and cannot provide an appropriate alternative, the customer will be offered a transfer, credit, refund or other remedy in accordance with the applicable policy and Australian Consumer Law.
7. Program Changes
Excel Tennis may make reasonable changes to program timetables, coach allocations, venues or operational arrangements where required for safe and effective program delivery.
This includes substituting or reassigning coaches where necessary.
Excel Tennis will provide notice of material changes where reasonably practicable.
Any pricing changes will apply to future bookings or enrolments and will not be applied retrospectively to a confirmed booking.
8. Health, Safety and Participation
Participants are responsible for ensuring they are medically fit to participate in tennis coaching and related physical activities.
Customers must inform Excel Tennis of any medical condition, injury, allergy, disability or other circumstance that may affect safe participation.
Tennis and physical activity involve inherent risks, including slips, falls, collisions, physical exertion and impact injuries.
Participants must follow reasonable coaching, venue and safety instructions.
Where reasonably necessary, Excel Tennis may provide or arrange first aid, contact emergency services and take reasonable steps to protect a participant’s health and safety.
Appropriate physical contact may occasionally be required for coaching instruction, equipment adjustment, first aid or immediate safety.
9. Child Safety and Supervision
Excel Tennis is committed to providing a safe, welcoming and inclusive environment for children and young people.
Customers and participants must comply with the Excel Tennis Child Safety Policy and reasonable safety directions provided by staff.
Parents and guardians are responsible for ensuring children are appropriately dropped off and collected in accordance with the published arrangements.
Excel Tennis must be informed of any authorised collection arrangements or safety concerns relevant to a child.
10. Player and Parent Behaviour
Players, parents, guardians and visitors must behave respectfully towards coaches, staff, participants, families and venue representatives.
Unsafe, abusive, threatening, discriminatory, disruptive or otherwise inappropriate conduct will not be accepted.
Excel Tennis may respond to serious or repeated misconduct by:
- Issuing a warning;
- Removing a person from a session or venue;
- Suspending participation; or
- Cancelling an enrolment.
Any applicable credit or refund will be considered under the Excel Tennis Credit & Refund Policy, the circumstances of the conduct and applicable law.

11. Photography, Privacy and Communications
Excel Tennis may take photographs or videos during coaching sessions, programs and events in accordance with the Excel Tennis Photography & Videography Policy and any consent provided.
Customers who do not wish to be photographed or recorded must notify Excel Tennis in writing.
Personal information will be handled in accordance with the Excel Tennis Privacy Policy.
Customers must use official Excel Tennis communication channels for enrolment, payment, coaching and program matters.
Coaches are not required to provide personal contact details or communicate through personal social media accounts.
12. Personal Belongings and Property
Participants are responsible for the care and security of their personal belongings.
Excel Tennis is not responsible for personal items that are lost, damaged or stolen, except where required by law.
Customers or participants may be responsible for reasonable repair or replacement costs where facilities or equipment are deliberately or negligently damaged.
13. Website and Third-Party Services
Excel Tennis may use third-party providers for booking, payment, communication, website, Customer Portal and mobile application services.
Third-party services may be subject to their own terms and privacy policies.
Excel Tennis is not responsible for interruptions or failures outside its reasonable control but will take reasonable steps to assist where a system issue affects an Excel Tennis booking or payment.
Website content, logos, images, videos and coaching materials owned by or licensed to Excel Tennis must not be copied, distributed or commercially used without written permission.
14. Events Outside Our Reasonable Control
Excel Tennis is not responsible for delays or an inability to provide a service caused by circumstances outside its reasonable control, including venue closures, emergencies, government directions, natural disasters or utility failures.
Where reasonably possible, Excel Tennis will provide an alternative session, transfer, credit or other appropriate arrangement, having regard to the circumstances and applicable law.
15. Suspension and Cancellation
Excel Tennis may suspend or cancel an enrolment where:
- Payment remains unresolved;
- These Terms & Conditions or an Excel Tennis Policy are materially breached;
- Safety or welfare is at risk;
- Serious or repeated misconduct occurs;
- A service or program is discontinued; or
- Another reasonable and lawful basis applies.
Where reasonably appropriate, Excel Tennis will provide notice and an opportunity to address the issue before cancelling an enrolment.
Existing payment obligations, rights and liabilities remain unaffected by cancellation.
16. Liability and Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts or modifies:
- Consumer guarantees under the Australian Consumer Law;
- Liability that cannot lawfully be excluded; or
- Any other mandatory legal right or remedy.
To the extent permitted by law, Excel Tennis is not responsible for loss or injury caused by:
- A participant failing to follow reasonable instructions;
- Inaccurate or incomplete information provided by the customer;
- A medical condition, injury or safety concern that was not disclosed; or
- Circumstances outside Excel Tennis’s reasonable control.
Any limitation of liability will apply only to the extent permitted by law.
17. Changes to These Terms
Excel Tennis may update these Terms & Conditions to reflect changes to its services, systems, policies or legal obligations.
The current version will be published on the Excel Tennis website with an updated “Last Updated” date.
Where a change materially affects an existing enrolment or ongoing payment arrangement, Excel Tennis will provide reasonable advance notice.
Changes will not retrospectively remove customer rights or impose new material obligations on a confirmed booking without the customer’s agreement or another lawful basis.
18. Governing Law and Contact Information
These Terms & Conditions are governed by the laws of Victoria, Australia.
Before commencing formal proceedings, the customer and Excel Tennis should make reasonable efforts to resolve any dispute through good-faith communication.
